The purpose of this memorandum is to provide additional information on the 5-year review cycle provision of the Child Nutrition Program Integrity final rule. This memorandum relates to program-specific changes in the National School Lunch Program and School Breakfast Program.
Attached to this memorandum, please find a revised edition of the Prototype Application for Free and Reduced Price School Meals, with an accompanying instructions document. This letter is in response to correspondence from WIC state agencies using offline Electronic Benefit Transfer (EBT) technology or paper food instruments, and requesting program flexibility from the WIC program federal requirements as a result of the impact of the ongoing COVID-19 pandemic and the 2022 Abbott recall of certain powder infant formula, exempt infant formula, and WIC-eligible nutritionals on the nationwide supply chain leading to both periodic location- and product-based WIC infant formula and exempt infant formula shortages.
FNS is committed to providing WIC participants with access to a variety of safe and healthy foods, including infant formula, and strongly encourages WIC state agencies to take expedient action to ensure that WIC participants can exchange recalled product on hand, and can use WIC benefits in their EBT balance or on paper WIC food instruments to purchase product that has not been recalled
This waiver facilitates state agencies abilities to conduct a school meal programs administrative review when a school food authority is only operating the National School Lunch Program Seamless Summer Option in SY 2021-22.
FNS waives, for all state agencies and school food authorities, school meal programs onsite monitoring requirements. This waiver extends the Nationwide Waiver of Onsite Monitoring Requirements in the School Meals Programs – Revised – Extension 2 granted on Aug. 4, 2020 that expires on June 30, 2021.
