The purpose of this memorandum is to provide additional guidance on the use of school and census data to establish area eligibility in CACFP, SFSP, and the Seamless Summer Option of the NSLP. In addition, this memorandum consolidates previous guidance and simplifies the area eligibility determination process to reduce administrative burdens on state agencies and program operators.

This memorandum clarifies the uses of State Administrative Expense funds for administrative and other expenses incurred in the food distribution program for child nutrition programs.

This memo clarifies the small purchase threshold applicable to procurements under FNS programs.

This instruction is intended to clarify allowable variations to child nutrition program food components in order to meet religious needs among Jewish schools, institutions and sponsors. 

This Instruction prohibits the denial of meals and milk as a disciplinary action against any child who is enrolled in a school participating in the Chile Nutrition Programs. Such denial of meals or milk is inconsistent with Section 2 and 9 of the National School Lunch Act and Sections 2,3, and 4 of the Child Nutrition Act of 1966.

This Instruction sets forth the policy with respect to reimbursement of meals consumed off-site under the National School Lunch, Commodity School, and School Breakfast Programs.
