USDA is aware of increased reports of EBT theft due to card skimming, cloning, and similar fraudulent methods. On Dec. 29, 2022, President Joseph R. Biden signed into law the Consolidated Appropriations Act, 2023 (the Omnibus), which includes provisions for the replacement of stolen EBT benefits with federal funds.
USDA's FNS and ACF at the Department of Health and Human Services are aware of increasing reports of benefit theft by criminal actors through EBT card skimming schemes. After discussions with EBT processors and fraud prevention stakeholders, FNS and ACF have identified prevention measures that can be adopted to improve card security while we work towards longer-term strategies.
When the COVID-19 Public Health Emergency began in March 2020, FNS quickly responded by allowing state agencies to suspend requirements to conduct face-to-face interviews for QC active reviews. This flexibility was initially granted until Sept. 30, 2020, and then extended through Dec. 31, 2020. On April 30, 2021, FNS issued a memo that SNAP QC will resume nationwide starting July 2021, but provided state agencies with a blanket waiver of the QC face-to-face interview through Dec. 31, 2021.
FNS will not allow states to adjust adverse action requirements. States would have been allowed to suspend termination of cases and/or reducing benefit levels when cases should have been terminated or benefits reduced.
