This memorandum and attachment provide information on the release of the revised Federal-State Agreement for Child Nutrition and Food Distribution Programs, form FNS-74. This agreement between the Food and Nutrition Service (FNS) and state agencies is used to set out the requirements for administering the child nutrition programs per 7 CFR 235.3(b).

The attached FNS-74 was approved by the Office of Management and Budget on Aug. 10, 2016 and is effective immediately. 

The new version of the form includes requirements relating to the administration of the Fresh Fruit and Vegetable Program and removes the requirements relating to the administration of the Nutrition Education Training Program. The form will continue to report the requirements for the administration of the child nutrition programs and food distribution programs that were previously listed on the older version of the agreement. The new form also removes the option of selecting programs to be administered to nonprofit summer camps, although it remains possible to select “other” to report the administration to this group of organizations. 

As the previous versions of this form are obsolete, state agencies must submit a signed and dated copy of this revised FNS-74 to their respective FNS regional office for federal fiscal year 2017. As state distributing agencies will also need to submit a separate signed and dated copy of this revised FNS-74 as it pertains to food distribution, separate guidance will be issued by the FNS Food Distribution Division.
