This final Rule:

Retains all provisions in the interim rule published on January 21, 2000. These provisions, as set forth in law, require WIC applicants, except in limited circumstances, to present documentation of family income at certification for those individuals who are not certified based on adjunctive income eligibility procedures, present proof of residency, and physically present themselves at certification.

Includes several new nondiscretionary legislative WIC certification integrity provisions contained in the Agricultural Risk Protection Act of 2000, as subsequently amended by the Grain Standards and Warehouse Improvement Act of 2000. These provisions include:

• alternative procedures to document residency for WIC applicants who reside in a remote Indian or Native village or are served by an Indian tribal organization and residing on a reservation or pueblo;
• a definition of "remote Indian or Native village;" and,
• the option for State agencies to exclude from consideration as income, in determining WIC eligibility, any cost-of-living allowance provided to military personnel who are on duty outside the contiguous states of the United States.
