SNAP statutes and regulations provide the state SNAP agency with certain options to tailor SNAP according to their respective operational considerations and policy preferences. FNS develops a State Options Report documenting state by state choices on a limited number of these options. These reports are not a comprehensive reflection of all policy and administrative options available to states. The latest report is the 15th edition published in October 2023.

Introduction

This report summarizes 19 SNAP policy options (in effect as of Oct. 1, 2022) and waivers (implemented as of July 1, 2023) chosen by SNAP state agencies (50 states, the District of Columbia [DC], Guam, and Virgin Islands) in federal fiscal year (FY) 2023.

SNAP’s statutes, regulations, and waiver authority provide state agencies with choices on how to administer SNAP. State agencies use this flexibility to adapt their programs to best meet the needs of eligible households with low incomes in their jurisdictions. This flexibility helps state agencies simplify program administration and operations and promote service delivery, tax stewardship, and program integrity.

FNS and Westat developed this report using extant data from the FY 2023 SNAP State Plans of Operation, SNAP Quality Control State Profiles, and approved waivers.

This report has three parts:
  1. The Statutory and Regulatory Citations reference page provides statutory and regulatory citations for each policy option. This page guides the reader to relevant provisions of the Food and Nutrition Act of 2008 and Title 7 of the Code of Federal Regulations.
  2. Section 1 describes each policy option, the choices within that option, and a map of the state agencies that have selected the option.
  3. Section 2 provides a state-by-state summary of the options each state agency has chosen. Click on a state in the map below to view their summary.
