Adjusted Fiscal Year (FY) 2004 15 Percent Exemptions

Attached is the list of adjusted FY 2004 15 percent
ABAWD exemption numbers. These figures include the number of actual 15
percent “slots” used by States that were reported in their final FY
2003 FNS-583 reports.
Based on our calculations, three States (Arizona,
Iowa, and Kansas) used more slots than they were allotted in FY 2003. When we added the negative numbers from FY 2003 to the FY 2004
exemptions, the adjusted amount was a negative number. Therefore, these State now have no 15 percent exemptions for FY
2004. Please notify these
States that they must immediately cease granting such exemptions. It is imperative that States not go beyond the number of 15 percent
exemptions they were allotted.
Also, for Quality
Control review of cases in Arizona, Iowa and Kansas during the FY 2004
review period and until the State receives additional 15 percent slots,
cases must be carefully checked for compliance with ABAWD requirements. State records indicating a 15 percent exemption will not be
accepted during this time period of having no slots. Cases which participated based only upon a 15 percent exemption
should be further checked to see if they were otherwise eligible to
individuals who did not meet ABAWD requirements will be found to be
ineligible if they have used the applicable number of ABAWD months.
When you look at the attached list you will note that
eight States have blank spaces for their FY 2004 carryover amount. These States may have submitted FNS-583 reports for the 4th
quarter. However, we do not
have access to this information at this time. We will send you the adjusted figures for these states as soon as
